OFFICIAL RULES
No purchase necessary to enter or win. A purchase will not improve your chances of winning. Sweepstakes begins on October 19, 2007 and ends March 8, 2008.
ELIGIBILITY. Sweepstakes is open only to legal residents of Minnesota and Wisconsin who are 18 years or older at time of entry. Employees, directors and officers of Sponsor, the WCHA, University of Minnesota, University of Minnesota-Duluth, Mankato University and St. Cloud State University, their parents, affiliated and subsidiary companies, advertising and promotion agencies, suppliers, and others involved in the creation, production or execution of this Sweepstakes (collectively, the Sweepstakes Entities), and members of their respective immediate family (spouses, parents, siblings and children and their spouses) and households (whether or not related) are not eligible. No groups, clubs of organizations can participate in this promotion on behalf of the group, club or organization. Void where prohibited and subject to all laws.
HOW TO ENTER. To enter, complete an official entry form as directed, available at dqcup.com (the “Website”) by 11:59 PM, March 8, 2008. Sponsor’s (or its designated agent’s) computer will be the official promotion time clock. Winners will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and, except where prohibited, a Publicity Release within time specified by Sponsor. If required documents are not timely returned, prize will be forfeited. Enter as often as you wish, but no more than once per business day. All entries become the property of the Sponsor and will not be acknowledged or returned. Not responsible for late, lost, stolen, misdirected, misplaced, illegible, mutilated, damaged or incomplete entries.
For purposes of these Official Rules, “receipt” of an online entry occurs when Sponsor’s servers record the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor of an online entry. Although subsequent attempts to enter may be received on any day, only the first entry received from a particular individual on that day will count. Every entry must be manually keystroked by entrant. Automated entries (including but not limited to entries submitted using any bot, script, macro, or Sweepstakes service), third party entries, copies, facsimiles and/or mechanical reproductions are not permitted and will be disqualified.
The person submitting an online entry must be the authorized account holder of the email address provided with the entry. “Authorized account holder” is the natural person who is assigned to an email address by the Internet Access Provider, online service provider, or other organization that is responsible for assigning email addresses. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to be submitted by the person in whose name the email account is registered. If a winning entry is an online entry, the potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with that entry.
Sponsor is not responsible for any computer, online, telephone or technical malfunctions that may occur, for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries or for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers on account of technical problems or traffic congestion on the Internet, at any website or on account of any combination of the foregoing. Sponsor is not responsible for any injury or damage to participants or to any computer related to or resulting from participating in Sweepstakes or downloading Sweepstakes information or materials. If, for any reason, the Sweepstakes is not capable of running as planned, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part and randomly select winners from among all eligible entries legitimately received prior to the cancellation, termination or modification. Notice of any cancellation, termination or modification will be posted on the Website.
By entering the Sweepstakes, participants agree to Sponsor’s use of their personal information. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering or attempting to tamper with the entry process or violating the Official Rules, or acting in an unsportsmanlike or disruptive manner.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND ALL OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
WINNER SELECTION/NOTIFICATION. One winner will be randomly selected in drawings from each of the four metro area pools on or about a week in advance of the “Shoot to Win” night to be held at each of the four colleges (approximately 1/12/08 for UMD, 1/18/08 for Minnesota State, 1/19/08 for St. Cloud State and 3/1/08 for the University of Minnesota). Odds of winning each prize depend on the total number of entries attributable to each of the respective pools for which a winner will be drawn. Winners will be notified by a verifiable means and will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and, except where prohibited, a Publicity Release within time specified by Sponsor. If required documents are not timely returned or if prize notification is returned as undeliverable after first attempt, prize will be forfeited and awarded to a randomly selected alternate if time and scheduling permit.
PRIZES. Each one of the four winners will receive four tickets (exact seats to be designated by Sponsor) for the designated WCHA game in the metro area in which that area’s winner submitted their entry (1/19/08 in Duluth, 1/25/08 in Mankato, 1/26/08 in St. Cloud, and 3/8/08 in Minneapolis). Approximate Retail Value (ARV) of each prize is $88 (4 tickets x $22). Each winner will have the opportunity to take 20 shots on goal within 30 seconds from halfway between the blue line and the goal at their designated game. If a winner makes five shots, he/she wins a dozen Blizzard® coupons, good for one 12 oz. Blizzard® a month for twelve months. (ARV $39.00). If a winner makes 10 shots, he/she wins 24 Blizzard® coupons, good for two 12 oz. Blizzards® a month for twelve months (ARV $78.00). Additionally, each person seated in the same section as the contestant that night wins a free GrillBurger® or Chicken Strip Basket coupon, as designated by Sponsor. If winner makes 15 shots or more, he/she gets 52 Blizzard® coupons, good for one 12 oz. Blizzard® a week for one year. (ARV: $169.00). A winning goal will result in each person who is present in the section that the winner is sitting in at that game being awarded a coupon for a free GrillBurger® basket. (ARV $4.69). Near the end of the hockey season, one additional winner will be randomly selected by Sponsor from among all remaining entries, and will be awarded 52 Blizzard® coupons, good for one twelve-ounce Blizzard® a week for one year. Odds of winning fifth prize depend upon number of remaining entries at time of drawing. Coupons can be redeemed only at participating DQ restaurants, and are subject to terms, conditions and restrictions.
Prize does not include personal expenses, travel arrangements between winner’s home and game, parking, gratuities, food, merchandise, souvenirs, beverage or other incidental charges. All taxes attributable to prize(s) are winner’s responsibility. No prize transfers or cash or other substitutions, except that Sponsor may substitute a prize, in whole or in part, for one of comparable or greater value in the event advertised prize, as determined by Sponsor in its sole discretion, is unavailable. Odds of winning the prize in each drawing depend(s) on total number of eligible entries received each respective metro area.
RELEASES. By participating, entrants agree to these Official Rules and to the decisions of the Sponsor and judges, which shall be final in all respects, including (without limitation) all decisions regarding eligibility, compliance with these rules, the selection of winners, the award of prizes and the administration of all drawings and events; to release and hold the Sweepstakes Entities, their parents, subsidiaries and other affiliated companies, advertising and promotion agencies, judging organizations, promotion administrators and their respective directors, agents and employees harmless from all liability, loss, personal injury or death, or damage to reputation or of any kind attributable in whole or in part, directly or indirectly, to their participation in the Sweepstakes or their acceptance and/or use of a prize or travel to or from or participation in any prize-related activity; and if a winner, to Sponsor’s unrestricted use in all media of winner’s name, voice, likeness, statements, biographical information and state of residence for advertising and promotional purposes, without notice, additional compensation, credit, or right of review or approval, except where prohibited.
Any promotion materials, including the offer or these Official Rules, which contain production, printing or typographical errors, or are obtained outside authorized or legitimate channels are void; and Sponsor’s liability, if any, is limited to the replacement of such materials. Recipients of such materials release the Sweepstakes Entities from any and all losses, claims or damages that may result therefrom. Sweepstakes materials are automatically void if they are reproduced, mutilated, forged, altered or tampered with in any way, or if they are obtained outside authorized, legitimate channels.
ARBITRATION/CHOICE OF LAW. Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then in effect, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant in connection with this Sweepstakes, but in no event attorneys’ fees, punitive, incidental, consequential or other damages. All issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and/or Sponsor’s agencies in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Minnesota. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
